NEMBA and the AIS Regulations

The National Environmental Management Biodiversity Act 10 of 2004 (NEMBA) Alien and Invasive Species (AIS) Regulations and Lists came into effect on the 1st October 2014.

The NEMBA AIS Regulations are grouped into 4 categories:

  • Category 1a: Invasive species which must be combatted and eradicated
  • Category 1b: Invasive species which must be controlled.
  • Category 2: Invasive species which require a permit. However if Category 2 plant species occur in riparian areas, they are elevated to Category 1b.
  • Category 3: Invasive species which may remain in certain areas or provinces. Again, however if Category 3 plant species occur in riparian areas, they are elevated to Category 1b.

Land-owners are required to control the listed invasive species on their properties, and prevent them from spreading. Failure to do so can result in legal action or a fine issued and/or clearance of the listed species at the cost of the land-owner.
